Terms and Conditions for Using “Gujarati Vaishnav” Portal and Mobile App

Evergreen Digital Solution is developing and operating this web portal and mobile application for members of Gujarati Vaishnav Sampradaya worldwide. This portal enables members to connect socially, build professional networks, develop business relationships and find suitable marriage partners in the Lohana community.

By creating an account on this portal, you agree to abide by the following terms and conditions. These terms are legally binding on all registered users.

1. Only members of Gujarati Vaishnav Sampradaya worldwide who are 12 years of age or older and reside anywhere in the world are eligible to register. As per the law of the Government of India, a woman of 18 years and a man of 21 years of age can create a matrimonial profile.
2. It is mandatory for every member to upload a profile photograph and a valid government ID card for proof of identity and identity, the profile photo will be matching with the photo of the valid government ID card and identity card. Only that account will be considered a verified profile and a blue tick will be visible next to the verified account profile.
3. “Evergreen Digital Solution”, which operates the “Gujarati Vaishnav Portal-App”, reserves the right to suspend or permanently close any account that is not verified.
4. Evergreen Digital Solution owns and operates this portal. Evergreen may, at its sole discretion, enter into or terminate an agreement with an organization working for charitable purposes for Gujarati Pushti Margi Vaishnav.
5. Registration and use of the portal is currently free. However, Evergreen Digital Solution reserves the right to charge membership fees in the future to cover ongoing expenses.
6. If an organization working for charitable purposes for Gujarati Pushti Margi Vaishnavas enters into an agreement with Evergreen Digital Solution, then membership fees may be imposed on users as per the terms of that agreement.
7. Obscene language, photographs, videos or any indecent content is strictly prohibited. The profile of a member violating this rule may be suspended or terminated by Evergreen Digital Solution and appropriate legal action may be taken.
8. Members are prohibited from posting content that is derogatory to the Lohana community, other religions or religious leaders. Evergreen Digital Solution may suspend or terminate such profiles and take legal action if necessary.
9. Political posts not related to the Vaishnav community or content that is hostile to any political party or public figure are prohibited. Evergreen Digital Solution reserves the right to suspend or terminate such accounts.
10. Members may not use the Portal to promote or advertise external products, services or commercial entities. Violation of this rule may result in account termination.
11. Evergreen Digital Solution is not responsible for any marital relationship formed through this Portal. Members should conduct their own investigation and verification before entering into a marital agreement.
12. This Portal is for social and professional networking among members of Gujarati Vaishnavas worldwide. Any financial or business dealings between members are entirely their personal responsibility.
13. Members may not use the Portal to appeal for donations from any organization without the prior approval of Evergreen Digital Solution.
14. Only organizations that have entered into exclusive agreements with Evergreen Digital Solution may use the Portal for authorized donation or fundraising purposes.
15. Evergreen Digital Solution reserves the right to display advertisements from local and foreign organizations on the Portal and mobile application to generate revenue.
16. These terms and conditions may be amended in the future based on agreements entered into between the organization working for charitable purposes for Gujarati Pushti Margi Vaishnav and Evergreen Digital Solution.
17. Evergreen Digital Solution reserves the right to change, update or amend these terms and conditions at any time without prior notice.

The web portal and mobile application are fully owned by Evergreen Digital Solution, which may enter into a long-term management agreement with the organization working for charitable purposes for Gujarati Pushti Margi Vaishnav.

All services provided through this portal are legally binding under the laws of India. The courts of Bhavnagar District, State of Gujarat, India shall have exclusive jurisdiction in any legal matter arising out of the use of this portal.

Child Safety Standards (CSAE) — Gujarati Vaishnav

This section states the published child safety standards for the LB - Lohana Book web portal and mobile application (including the Android app published on Google Play as Lohana Book / com.lohanabook.app), operated by Evergreen Digital Solution.

1. Prohibition of CSAE / CSAM. Child sexual abuse and exploitation (CSAE), child sexual abuse material (CSAM), grooming, sexual content involving minors, and any attempt to exploit children are strictly prohibited on LB - Lohana Book. Registration is limited to users 18 years of age or older. Any such content or conduct may result in immediate account suspension or termination and may be reported to law enforcement and applicable child-protection authorities.
2. User feedback and reporting. Users may report concerns about safety, abuse, illegal content, or child safety through: (a) in-app support / help chat on the portal; (b) contacting portal administrators via the official contact email used for LB - Lohana Book support; or (c) other reporting channels made available in the product. Reports will be reviewed and appropriate action taken under these standards and the Terms.
3. Addressing CSAM. Upon obtaining actual knowledge of CSAM or similar child exploitation content on our platform, we will take appropriate action, including removal of the content, restriction or termination of the responsible account(s), and preservation of records as required for lawful reporting and investigation.
4. Compliance with child safety laws. We aim to comply with applicable child safety laws and regulations. Where we confirm CSAM, we will report it to the appropriate authority for the jurisdiction, which may include the National Center for Missing and Exploited Children (NCMEC) and/or relevant authorities in India (or other applicable regional bodies), as required by law and operational process.

Evergreen Digital Solution વિશ્વભરના ગુજરાતી વૈષ્ણવ સંપ્રદાયના સભ્યો માટે આ વેબ પોર્ટલ અને મોબાઇલ એપ્લિકેશન વિકસાવી અને સંચાલિત કરી રહી છે. આ પોર્ટલ સભ્યોને સામાજિક રીતે જોડાવા, વ્યાવસાયિક નેટવર્ક બનાવવા, વ્યવસાયિક સંબંધો વિકસાવવા અને લોહાણા સમાજમાં યોગ્ય વિવાહ જીવનસાથી શોધવા માટે સક્ષમ બનાવે છે.

આ પોર્ટલ પર એકાઉન્ટ બનાવીને, તમે નીચેના નિયમો અને શરતોનું પાલન કરવા સહમત થાઓ છો. આ શરતો બધા નોંધાયેલા ઉપયોગકર્તાઓ માટે કાયદેસર રીતે બંધનકર્તા છે.

1. ફક્ત વિશ્વભરના ગુજરાતી વૈષ્ણવ સંપ્રદાયના સભ્યો જે 12 વર્ષ કે તેથી વધુ ઉંમરના હોય અને વિશ્વમાં ગમે ત્યાં રહેતા હોય, નોંધણી કરવા પાત્ર છે. ભારત સરકારના કાયદા મુજબ 18 વર્ષની મહિલા અને પુરુષ 21 વર્ષ ઉંમરના હશે, એ જ લાયક મેટ્રીમોનિયલ પ્રોફાઇલ બનાવી શકશે.
2. દરેક સભ્યે ઓળખ અને ઓળખના પુરાવા માટે પ્રોફાઇલ ફોટોગ્રાફ અને માન્ય સરકારી ઓળખપત્ર અપલોડ કરવું અનિવાર્ય છે; માન્ય સરકારી ઓળખપત્ર અને ઓળખપત્રના ફોટો સાથે મેચ થતો પ્રોફાઇલ ફોટો હશે. એ એકાઉન્ટ જ વેરિફાઇડ પ્રોફાઇલ ગણાશે અને વેરિફાઇડ એકાઉન્ટ પ્રોફાઇલ પાસે બ્લૂ ટિક દેખા મળશે.
3. વેરિફાઇડ ના હોય એ એકાઉન્ટ સસ્પેન્ડ કે કાયમી બંધ કરવાનો “ગુજરાતી વૈષ્ણવ પોર્ટલ-એપ”નું સંચાલન કરનાર “એવરગ્રીન ડિજિટલ સોલ્યુશન”ને અધિકાર અબાધિત રહેશે.
4. Evergreen Digital Solution આ પોર્ટલનું માલિકી અને સંચાલન કરે છે. Evergreen તેની વિવેકબુદ્ધિ પ્રમાણે ગુજરાતી પુષ્ટિ માર્ગી વૈષ્ણવ માટે ચેરિટેબલ હેતુથી કામ કરતી સંસ્થા સાથે કરાર કરી શકે અથવા સમાપ્ત કરી શકે છે.
5. પોર્ટલની નોંધણી અને ઉપયોગ હાલમાં નિઃશુલ્ક છે. જો કે, ચાલુ ખર્ચ ઉઠાવવા માટે Evergreen Digital Solution ભવિષ્યમાં સભ્યપદ ફી લેવાનો અધિકાર અબાધિત રાખે છે.
6. જો ગુજરાતી પુષ્ટિ માર્ગી વૈષ્ણવ માટે ચેરિટેબલ હેતુથી કામ કરતી સંસ્થા Evergreen Digital Solution સાથે કરાર કરે, તો તે કરારની શરતો અનુસાર ઉપયોગકર્તાઓ પર સભ્યપદ ફી લાગુ કરી શકાય છે.
7. અશ્લીલ ભાષા, ફોટોગ્રાફ, વીડિયો અથવા કોઈ પણ અસભ્ય સામગ્રી સંપૂર્ણપણે પ્રતિબંધિત છે. આ નિયમનું ઉલ્લંઘન કરનાર સભ્યનું પ્રોફાઇલ Evergreen Digital Solution દ્વારા સસ્પેન્ડ અથવા સમાપ્ત કરી શકાય છે અને યોગ્ય કાયદાકીય પગલાં લઈ શકાય છે.
8. સભ્યોને લોહાણા સમાજ, અન્ય ધર્મો અથવા ધાર્મિક નેતાઓને અપમાનિત કરતી સામગ્રી પોસ્ટ કરવી પ્રતિબંધિત છે. Evergreen Digital Solution આવા પ્રોફાઇલો સસ્પેન્ડ અથવા સમાપ્ત કરી શકે છે અને જરૂર પડે તો કાયદાકીય પગલાં લઈ શકે છે.
9. વૈષ્ણવ સમાજ સાથે સંબંધિત ન હોય તેવી રાજકીય પોસ્ટો અથવા કોઈ પણ રાજકીય પાર્ટી કે જાહેર વ્યક્તિ સામે વિરોધી સામગ્રી પ્રતિબંધિત છે. Evergreen Digital Solution આવા એકાઉન્ટ્સ સસ્પેન્ડ અથવા સમાપ્ત કરવાનો અધિકાર રાખે છે.
10. સભ્યો પોર્ટલનો ઉપયોગ બાહ્ય ઉત્પાદનો, સેવાઓ અથવા વાણિજ્યિક સંસ્થાઓના પ્રચાર અથવા જાહેરાત માટે કરી શકતા નથી. આ નિયમનું ઉલ્લંઘન એકાઉન્ટ સમાપ્તિનું કારણ બની શકે છે.
11. આ પોર્ટલ દ્વારા રચાયેલા કોઈ પણ વિવાહિક સંબંધ માટે Evergreen Digital Solution જવાબદાર નથી. વિવાહિક કરાર કરતા પહેલાં સભ્યોએ પોતાની તપાસ અને ચકાસણી કરવી જોઈએ.
12. આ પોર્ટલ વિશ્વભરના ગુજરાતી વૈષ્ણવોના સભ્યો વચ્ચે સામાજિક અને વ્યાવસાયિક જોડાણ માટે છે. સભ્યો વચ્ચેના કોઈ પણ આર્થિક અથવા વ્યવસાયિક વ્યવહાર સંપૂર્ણપણે તેમની વ્યક્તિગત જવાબદારી છે.
13. સભ્યો Evergreen Digital Solutionની પૂર્વ મંજૂરી વિના કોઈ પણ સંસ્થા તરફથી દાનની અપીલ કરવા માટે પોર્ટલનો ઉપયોગ કરી શકતા નથી.
14. ફક્ત Evergreen Digital Solution સાથે વિશિષ્ટ કરાર કરેલી સંસ્થાઓ જ અધિકૃત દાન અથવા ફંડ ઉભારણી હેતુ માટે પોર્ટલનો ઉપયોગ કરી શકે છે.
15. Evergreen Digital Solution પોર્ટલ અને મોબાઇલ એપ્લિકેશન પર આવક મેળવવા માટે સ્થાનિક અને વિદેશી સંસ્થાઓની જાહેરાતો દર્શાવવાનો અધિકાર રાખે છે.
16. ગુજરાતી પુષ્ટિ માર્ગી વૈષ્ણવ માટે ચેરિટેબલ હેતુથી કામ કરતી સંસ્થા અને Evergreen Digital Solution વચ્ચે થતા કરારોના આધારે ભવિષ્યમાં આ નિયમો અને શરતોમાં સુધારો કરી શકાય છે.
17. Evergreen Digital Solution આ નિયમો અને શરતોમાં કોઈ પણ સમયે પૂર્વ સૂચના વિના ફેરફાર, અપડેટ અથવા સુધારો કરવાનો અધિકાર રાખે છે.

વેબ પોર્ટલ અને મોબાઇલ એપ્લિકેશનની સંપૂર્ણ માલિકી Evergreen Digital Solution પાસે છે, જે ગુજરાતી પુષ્ટિ માર્ગી વૈષ્ણવ માટે ચેરિટેબલ હેતુથી કામ કરતી સંસ્થા સાથે લાંબા ગાળાના સંચાલન કરાર કરી શકે છે.

આ પોર્ટલ દ્વારા પ્રદાન કરવામાં આવતી બધી સેવાઓ ભારતના કાયદા હેઠળ કાયદેસર રીતે બંધનકર્તા છે. આ પોર્ટલના ઉપયોગથી ઉદ્ભવતા કોઈ પણ કાયદાકીય મામલામાં ભાવનગર જિલ્લાની કોર્ટ, ગુજરાત રાજ્ય, ભારતની વિશિષ્ટ અધિકારક્ષેત્ર હશે.
